TERMS & CONDITIONS

1. Agreement

We, RiverMint Dining, ABN 81 693 960 702, agree to provide Catering Services for the specified event date as outlined in the Catering Confirmation order under the conditions specified below.

2. Event Order

Final event numbers form the basis of our invoicing and initial deposit amount. Final invoices will reflect changes in numbers if confirmed by clients by 12 noon, 10 days prior to the event. Minor changes can be lodged up to 10am two days prior. All changes must be made in writing to the RiverMint Dining bookings team. Ability to accommodate changes is at the discretion of RiverMint Dining.

Please Note: Our team understands the importance of catering for special dietary requirements. Menus can be tailored to suit these needs if confirmed within the specified timeframes. Please note that the preparation kitchen is not gluten or nut free and steps will need to be taken prior if these allergies are severe. The preparation kitchen may have traces of wheat, soy, nut and shellfish products.

3. Event Confirmation and Deposit Payment

A signed Catering Confirmation order and 50% deposit are required 30 business days prior to the event. Deposit payment is to be made by bank transfer.  Please note that only when a signed agreement and deposit have been received will the reservation be confirmed.

All event details must be confirmed in writing, including (but not limited to) room set up, final menu selection, numbers, finishing times and beverage arrangements, by 7 days prior to the event.

If both of the above are not completed within the specified time, RiverMint reserves the right to cancel your reservation.

A formal confirmation and run sheet will be issued to the client 7 days prior to the event outlining timings, confirmed menu, staff attendance and contact person. Final invoice will also be issued.

4. Final Payment

Final payment of event Catering services, minus deposit paid, is due seven days before the event. Payment is to be made to RiverMint Dining via bank transfer as per bank details provided on invoice.

Should further costs be incurred after final invoice has been paid, an extra invoice will be issued following the date of event catering services. Payment terms are 10 days after receipt of invoice.

5. Last Minute Bookings

RiverMint Dining will make every effort to provide catering for last minute events up to 40 people. Upon confirmation of ingredient availability and staffing, we will return your call as soon as possible. A signed Catering Confirmation order is required 7 business days before the event as well as full payment of event catering services.

6. Minimum Booking Requirements

Catering for different events has minimum numbers. Should original or final numbers not reach the minimum, the account will be paid in full as if minimum amount were reached. A minimum booking of 20 catered guests applies to all bookings, with the exception of the following:

(a) Canape parties require a minimum of 20 pax, for a minimum booking of 3 hours and minimum 8 canape items/person.

(b) Conference and meeting day packages require a minimum of 10 guests for a minimum of 3 hours for afternoon/morning tea bookings. Meetings over 5 hours must include lunch or dinner catering.

(c)  All private catering event bookings that occur outside a 20km radius of the Perth Metro area will incur a fuel distance fee and any travel expenses incurred for delivery of staff, food and equipment.

(d) All prices quoted per person are subject to change based on availability and seasonality. RiverMint takes care to ensure menus are designed with seasonal produce in mind. Should an item originally requested not be available, an appropriate substitute will be provided and the client informed.

(e) All private in-house catering includes a Private Chef. For bookings of between 6 guests and 25 guests, 1 wait staff is required at a rate of $30/ hour, minimum three hours. For sit-down catered events over 15 people, or canapé events over 25 people, a sous chef is required at a rate of $36/hour, minimum three hours. Additional charges for wait staff, food runners, kitchen porters and chefs will apply as numbers increase. See Event Order confirmation for necessary staffing costs.

(f)  Catering events occurring on Sundays or Public holidays will incur a surcharge of 10%.

(g) A minimum spend applies on Saturdays. Please see Event order for details.

(h) Where children are attending – if over 8 years of age they are payable at the same rate as adults. If under the age of 8, they are chargeable at half the adult price (subject to minimum numbers). Children under 3 years of age will be free of charge.

7. Rentals and Event Coordination Services

RiverMint Dining can manage event needs, staffing, tables, chairs, linens, crockery and cutlery, AV Equipment and floral arrangements. Rentals and Event Coordination Services are charged in addition to catering services. Alcohol Bar set-up can be hired on an individual contract basis. All venue hire negotiations and fees are to be dealt with by the client directly with the chosen venue. Contact RiverMint Dining for more information and pricing.

8. Cancellation

Cancellation fees will apply where costs have been incurred in regards to food, labour and equipment hire.  We may deduct the Cancellation fee from the deposit amount already paid. The following cancellation fees apply:

(a) 30% cancellation fee if event is cancelled less than 40 days, but more than 28 days, before date of Catering services.

(b) Full 50% deposit if agreement is cancelled less than 28 business days, but more than 14 days, before the event date of Catering services

(c) A 100% cancellation fee will be charged where RiverMint has not been informed of a cancelled event in writing 14 days or less before event date.

9. RiverMint Ticketed Events

Event ticket prices are quoted in Australian dollars (AUD) per person.  Public events tickets are transferrable, however re-sale is restricted.

By purchasing a ticket to a RiverMint event, you except our Terms and Conditions, and Cancellation Policy.

RiverMint Dining reserves the right to cancel any event should minimum numbers not be reached or due to unforeseen circumstances, such as severe weather conditions. In the unlikely event of this occurring, purchasers will be notified immediately and the ticket price fully refunded.

Full payment for tickets is required to confirm your place at an event table. Cancellation prior to 14 days before the event will receive 60% refund. No refunds are available if cancellation occurs less that 14 days prior to the event.

10. Indemnity

10.1  You indemnify us against any claim, expense, loss or damage we suffer if you, or any employee, agent or invitee of yours, directly or indirectly, and wilfully or negligently:

(a) damages or destroys any RiverMint property, or of another person located within the Venue for the purposes of this agreement; or of another person located within the Venue for the purposes of this agreement; or

(b) injures, or causes the death of, any person within the venue for the purposes of this agreement.

(c) This indemnity is an independent obligation, survives termination or expiry of this agreement, and includes any expense we incur on a full indemnity basis.

10.2  For staffed events, RiverMint Dining disposes of uneaten food and beverage items remaining upon the completion of each event. If you or any of your guests request to take any of the remaining uneaten food items, RiverMint Dining requires a signed food release form. You agree to indemnify, defend and hold RiverMint Dining and its affiliates and their respective employees, representatives, agents and independent contractors harmless from any claims, injuries, losses or damages (including personal injury, wrongful death, and attorney's fees) arising from or related to the post-event consumption of leftover catered food and beverage items.

10.3  RiverMint Dining conducts strict security and reference checks on its staff. We will not be held responsible for the theft, loss or damage to any personal effects of the Client or of the Clients guests.

11. Termination

Rivermint Dining may terminate this Agreement immediately at any time without notice to you if:

(a) The amount due is not paid to us under this agreement.

(b) The client or company becomes bankrupt.

(c) Any obligations under this agreement are not observed when requested

If this agreement is terminated, RiverMint Dining will not be held liable for any claim, loss or expense incurred as a consequence of termination.

12. Governing Law

The laws in force in Western Australia govern the terms of this Agreement. RiverMint Dining and you, the client, agree to submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in that State, including any courts of appeal from them.

Personally Identifiable Information: We use the information we collect to deliver our services to you, including: communicating with you, providing technical support, notifying you of updates and offers, sharing useful content, measuring customer satisfaction, diagnosing problems and providing you with a personalised website experience.

Marketing communications are only sent to you if you have requested or subscribed to them. You can opt out of our marketing communications at any time by unsubscribing or emailing us and your request will be actioned immediately.

Non-Personally Identifiable Information: We also use the information we collect in aggregated and anonymized forms to improve our services, including: administering our website, producing reports and analytics, advertising our products and services, identifying user demands and assisting in meeting customer needs generally.

Any information you choose to make publicly available, such as blog comments and testimonials on our website, will be available for others to see. If you subsequently remove this information, copies may remain viewable in cached and archived pages on other websites or if others have copied or saved the information.

Storage and security of your information

We will use all reasonable means to protect the confidentiality of your Personal Data while in our possession or control. All information we receive from you is stored and protected on our secure servers from unauthorized use or access. Credit card information is encrypted before transmission and is not stored by us on our servers.

To enable us to deliver our services, we may transfer information that we collect about you, including Personal Data, across borders for storage and processing in countries other than Australia. If your Personal Data is transferred and processed outside Australia, it will only be transferred to countries that have adequate privacy protections.

We retain your personal information for as long as needed to provide services to you and as otherwise necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

In the event there is a breach of our security and your Personal Data is compromised, we will promptly notify you in compliance with the applicable law.

Use of cookies allows a website to tailor its configuration to your needs and preferences. If there is a change of control in one of our businesses (whether by merger, sale, transfer of assets or otherwise) customer information, which may include your Personal Data, could be transferred to a purchaser under a confidentiality agreement. We would only disclose your Personal Data in good faith and where required by any of the above circumstances.
